Directions to Exempt

Under Part 3 of Schedule 4 to the Legal Services Act, the LSB has the power to exempt certain general or specific changes to the Regulatory Arrangements from the approval process by issuing a direction.
All directions will be issued directly to the Approved Regulator concerned. Copies will also be published here.

Exemptions

Date Title Description
30 December 2009 Exemption Direction 1 Alterations falling below a de minimus line (Paragraph 19(3) and (4) of Schedule 4 direction). LSB directs the exemption from the requirement for LSB approval for the types of alterations to Approved Regulators’ Regulatory Arrangements that are listed within the direction. These changes are considered to fall below a de minimus line. This direction is to be deemed made on and to be effective from 1 January 2010.
30 December 2009 Exemption Direction 2 Alterations relating to compliance with the Internal Governance Rules (Paragraph 19(3) and (4) of Schedule 4 direction). LSB directs the exemption from the requirement for LSB approval for alterations to Approved Regulators’ Regulatory Arrangements that are made in order to achieve compliance with the Internal Governance Rules, that have been subject to non-compliance notification requirements and that have been agreed by the LSB as part of on-going Section 30 implementation arrangements. This direction is to be deemed made on and to be effective from 1 January 2010.
31 December 2009 Exemption Direction 3 Alterations relating to CIPA and ITMA arrangements – transitional (Paragraph 19(3) and (4) of Schedule 4 direction). LSB directs the exemption from the requirement for LSB approval regulations made by ITMA in relation to section 83A Trade Marks Act 1994 and by CIPA in accordance with Section 275A of the Copyright, Designs and Patents Act 1998 and submitted prior to 1 January. This is to facilitate the transition from ownership of the relevant registers from the Intellectual Property Office to ITMA and CIPA on 1st January 2010. This direction is to be deemed made on and to be effective from 1 January 2010.
26 March 2010 Exemption Direction 4 Alterations relating to the BSB’s Continuing Professional Development regulations. LSB directs the exemption from the requirement for LSB approval for amendments made by the BSB in relation to its Continuing Professional Development regulations. This is to maintain the current arrangements in light of the introduction of the “authorisation to practise” regime under section 13(2) and Schedule 5 of the Legal Services Act 2007. This direction is to be deemed made on and to be effective from 22 March 2010.
30 April 2010 Exemption Direction 5 Alterations relating to the BSB’s Interim Suspension Rules and update of references to Bar Council, Bar Standards Board and Training Regulations. LSB directs the exemption from the requirement for LSB approval for amendments made by the BSB in relation to its Interim Suspension Rules and any updates of references to Bar Council, Bar Standards Board and Training Regulations within the Code. This is to update the current arrangements in light of the changes regarding Legal Disciplinary Practices and ensure consistency within the Code. This direction is to be deemed made on and to be effective from 30 April 2010.
13 July 2010 Exemption Direction 7 Alterations relating to the SRA’s alterations to Rule 4 of the Code of Conduct. LSB directs the exemption from the requirement for LSB approval for amendments made by the SRA to Rule 4 of the Code of Conduct. This direction is to be deemed made on and to be effective from 13 July 2010.
19 July 2010 Exemption Direction 6 Alterations relating to the BSB’s Hearings before the Visitors Rules and Complaints Rules. LSB directs the exemption from the requirement for LSB approval for amendments made by the BSB to its Hearings before Visitors Rules and Complaints Rules. This direction is to be deemed made on and to be effective from 16 July 2010.
21 July 2010 Exemption Direction 8 Alterations relating to the SRA’s Solicitors’ Compensation Fund Rules 2010 LSB directs the exemption from the requirement for LSB approval for amendments determined by the SRA of the Solicitors’ Compensation Fund Rules 2010 which sets the individual practitioner and firm contributions to the Compensation Fund. This direction is to be deemed made on and to be effective from 21 July 2010.
6 August 2010 Exemption Direction 9 Alterations to rules 204 and 508 of Bar Code of Conduct LSB directs the exemption from the requirement for LSB approval for amendments to the Bar Code of Conduct (Rule 204 and 508) determined by the BSB. This direction is to be deemed made on and to be effective from 6 August 2010.
20 August 2010 Exemption Direction 10 Alterations to SRA QLTS Day One Outcomes assessment LSB directs the exemption from the requirement for LSB approval for amendments to the SRA QLTS Day One Outcomes assessment. This direction is to be deemed made on and to be effective from 20 August 2010.
20 August 2010 Exemption Direction 11 Alterations relating to the Master of the Faculties Notaries (Supervision Fees) Regulation 2010 LSB directs the exemption from the requirement for LSB approval for amendments to the Master of the Faculties Notaries (Supervision Fees) Regulation 2010. This direction is to be deemed made on and to be effective from 20 August 2010.
20 August 2010 Exemption Direction 12 Alterations to Regulatory Arrangements relating to the commencement of the Legal Ombudsman LSB directs the exemption from the requirement for LSB approval of amendments to Approved Regulators’ Regulatory Arrangements that are listed within the direction. This direction is deemed to be made on and to be effective from 20 August 2010.
